A nine-digit number, and one question that decides what it costs

The number is free. The paperwork is short. Almost everything expensive about getting a Portuguese tax number comes from a single question — whether you need a fiscal representative — and the answer is given, in plain language, in a leaflet the tax authority publishes and almost nobody reads. For a large share of the people being quoted an annual fee, the answer is no.

The sentence that matters

Registration and representation are two different things

Most of the confusion, and most of the invoicing, comes from treating them as one. They are separated in the law and separated again in the tax authority’s own guidance.

Free
Getting the number

A passport or equivalent civil identification, and a document showing your address abroad unless the passport already shows it. Apply in person by appointment at any tax office or Loja do Cidadão, or electronically through the e-balcão. The tax authority’s note is unambiguous: at the moment of registration and NIF attribution to a foreign citizen as a non-resident, designating a fiscal representative is not mandatory.

No representative needed to get here
Later, maybe
The legal-tax relationship

The obligation attaches to what you do, not to the number. The tax authority names four things that create it: owning a vehicle registered in Portugal, owning property here, signing an employment contract for work here, or carrying on self-employed activity here. Have none of them and, in the authority’s own words, you are not a subject of a legal-tax relationship.

Four triggers, and that is the list
Optional
If you live in the EU, Norway, Iceland, Liechtenstein or Andorra

Always optional. Not “usually” and not “unless” — the word in the guidance is sempre facultativa. Andorran citizens resident in Andorra are included, which the shorter versions of this advice tend to drop.

No trigger changes this
Mandatory
Self-employment from outside the EU

The real exception. A non-EU resident carrying on self-employed activity in Portugal must appoint a VAT fiscal representative who is themselves a Portuguese VAT-registered taxable person, before the activity begins. Electronic notifications do not substitute, and the representative is jointly liable for the VAT.

Two questions, and the law gives the answer

Nothing here is our opinion. The branches below follow the tax authority’s published position, and the verdict names the rule it comes from.

Do you need a fiscal representative? Runs in your browser. Nothing is sent anywhere.

2Which of these is true for you in Portugal? Select all that apply.

Answer both questions and the verdict appears here, with the rule it rests on. The second question is the one that decides it: the obligation attaches to what you do in Portugal, not to holding the number.

Indicative, not advice. The branches follow the tax authority’s FAQ and its July 2025 leaflet on NIF attribution to non-resident foreign citizens. Edge cases exist — company directorships, trusts, inherited property mid-process — and the leaflet itself reads slightly differently from the FAQ on whether the self-employment rule reaches Norway, Iceland and Liechtenstein. If that is your situation, ask rather than assume.

If you do appoint one

What a representative is actually on the hook for

Both of the common beliefs are wrong. They do not take on your tax bill, and they do not merely forward post.

They are responsible for
  • Receiving correspondence from the tax authority — you are deemed domiciled at their address
  • Complying with ancillary tax duties, including filing income tax returns
  • Exercising your rights before the authority: complaints, hierarchical appeals, judicial challenges
  • The VAT, jointly with you, but only if you carry on self-employed activity subject to it
They are not responsible for
  • Paying your taxes — the tax authority states this plainly
  • Anything at all until they expressly accept the appointment
  • Staying forever: they may renounce, and the authority processes it after 90 days once a year has passed or a replacement is named
  • Being a Portuguese national — a foreign citizen with a valid residence permit, registered as resident, can serve

The acceptance step is where appointments silently fail. The tax authority posts a letter to the nominated representative containing a confirmation code, which they must enter on the Portal das Finanças. If they do not, the nomination simply expires after thirty days. People discover this months later, when a notification goes somewhere they are not.

Myths worth killing

Four things that are not true

1
“Getting a NIF makes you a Portuguese tax resident”

It does not. The NIF is identification, not status. Residence follows from more than 183 days in any twelve-month period beginning or ending in the year, or from keeping a home here in conditions that suggest you intend it as your habitual residence. Thousands of people hold a Portuguese NIF and are taxed nowhere near Portugal.

Identification, not status
2
“You get a new number when you move here”

The same nine digits follow you from non-resident to resident. What changes is the address on the register, which you must update within 60 days of meeting the residence test. The number does not change and you do not re-apply.

One number, for life
3
“A non-EU national always needs a representative”

Only with a legal-tax relationship, and then usually with a free alternative available. The blanket version of this claim is the single most profitable sentence in the sector, and the tax authority’s own leaflet contradicts it in a bold note.

Depends on four facts
4
“Electronic notifications are a loophole you can close later”

They are a lawful alternative, not a loophole — and you cannot simply close them. For residents outside the EU and EEA, cancelling the adherence only takes effect once a fiscal representative has been appointed. Article 19(16), added in 2022.

The things that actually hold applications up

Documents
Translations must be certified

Documents in a foreign language have to be submitted as a properly certified translation. Certification can come from notaries, from chambers of commerce and industry recognised under Decreto-Lei 244/92, or from lawyers and solicitadores. Originals or authenticated copies; plain copies only alongside the originals.

Budget time for this, not money
Passport
The entry-visa condition, and its exceptions

Where a third-country national applies in person themselves, the passport should carry the entry visa for Portugal — unless it shows an entry visa for any EU country, or the applicant is a national of a country exempt from visas for the Schengen area. Two exceptions that cover a great many applicants.

Check the exceptions before panicking
Power of attorney
Signature recognition is waived for lawyers

Someone else can apply for you with a power of attorney granting the relevant powers. Those powers of attorney are exempt from signature recognition when granted to a lawyer or solicitador identified as such — which removes a notarisation step that otherwise has to happen wherever you are.

Often the fastest route from abroad
Two roles
Legal representative is not fiscal representative

The leaflet flags this specifically. The person who files your NIF request through the e-balcão acts as your legal representative, a different figure from the fiscal representative. If the same person is to be both, the power of attorney has to say so expressly.

Say it in the document or it does not happen
Questions

What people ask after the first quote

Does a non-resident need a fiscal representative to get a NIF?

No. The tax authority states it twice in its own leaflet: at the moment of registration and attribution of a NIF to a foreign citizen as a non-resident, designating a fiscal representative is not mandatory. The obligation, where it exists at all, arrives later and separately, when you form what the law calls a legal-tax relationship.

What creates a legal-tax relationship?

The tax authority gives four examples: owning a vehicle registered in Portugal, owning property situated in Portugal, signing an employment contract for work in Portugal, or carrying on self-employed activity in Portugal. If none of these applies to you, there is no obligation to appoint a representative or to adhere to electronic notifications at all.

How much does a NIF cost?

Nothing. The number is issued free of charge, whether you apply in person at a tax office or a Loja do Cidadão by appointment, or electronically through the e-balcão. What costs money is a representative, if you need one or choose one — and an agency fee for the application itself, if you pay someone to submit it.

Who is exempt from the representative requirement?

Residents of the European Union, Norway, Iceland and Liechtenstein, and Andorran citizens resident in Andorra. For them both a representative and electronic notifications are, in the tax authority’s own word, always optional. For residents of other countries it depends on whether a legal-tax relationship exists.

Can I avoid the representative by using electronic notifications?

In most cases yes. A third-country resident with a legal-tax relationship may choose either a fiscal representative or adherence to the electronic notification channels — the Portal das Finanças system or the ViaCTT mailbox. The electronic route is free. The exception is self-employed activity, where a VAT fiscal representative remains mandatory regardless.

What happens if I do not appoint one when I should?

A fine of €75 to €7,500 under article 124 of the RGIT, and, which usually matters more, you cannot exercise your rights before the tax authority — including complaints, hierarchical appeals and judicial challenges. A designation that omits the representative’s express acceptance is penalised the same way.

Does having a NIF make me a Portuguese tax resident?

No. The NIF is an identification number, not a status. You become tax resident by spending more than 183 days in Portugal in any twelve-month period beginning or ending in the year, or by having a home here in conditions suggesting you intend to keep it as your habitual residence. When that happens you must update your address within 60 days — and the number itself does not change.

Is the representative liable for my taxes?

As a rule, no. The tax authority is explicit that the fiscal representative is not responsible for paying the non-resident’s taxes. The exception is self-employed activity subject to VAT, where the representative is jointly liable for the VAT — which is exactly why that service is priced differently from a mailbox.

We will tell you if you need us for this

If the tool above said no obligation, you have what you need and we would rather you kept the money. If it said otherwise — a company you are forming, self-employment, property, or a structure the four triggers do not cleanly describe — tell us the facts and we will set it up correctly the first time, including the acceptance step that quietly defeats most appointments.
